Scope of application,
The terms and conditions contained in this document shall apply to the relationship between the visitor (hereinafter referred to as "Client") and SEIXOMIL - CASA DE CAMPO BOUTIQUE DESIGN (owned by Wondercash, Lda, NIF: 510136508 with registered office at Rua Barão Forrester 790, 4050-272 Porto) from the moment the booking is requested until the moment the period of accommodation at SEIXOMIL - CASA DE CAMPO BOUTIQUE DESIGN ends. Where these Terms and Conditions do not apply, the Portuguese legislation in force shall apply.
1. Execution of the Agreement
1. When requesting a room reservation, the Client makes an accommodation offer to SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN If any room availability SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN will provide the Customer with a reservation code.
2. The Client is informed that reservations for rooms at SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN made through third parties (tour operators or on internet room reservation portals) determine the issuance of a reservation code different from the one issued directly by SEIXOMIL – BOUTIQUE DESIGN COUNTRY HOUSE is, however, equally valid.
3. Requests for room reservations made directly to SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN or through third parties are not binding and do not oblige SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN to enter into a contract with the Client. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN will always have the right to refuse to enter into a contract and make room available at its sole and discretionary discretion.
4. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN only guarantees the Client the availability of a room of the reserved category.
2. Cancellation
Fully refundable cancellations up to 48 hours before check-in, after this period a fee of 50% of the initial reservation will be charged.
NON-REFUNDABLE CANCELLATIONS ON THE DAY OF CHECK-IN.
3. Arrival and Departure
1. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN will provide the Client with a room from the date of arrival or, if the Client has not made a reservation and hires SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN in the accommodation according to the availability of the accommodation, in principle from 2 pm and at the latest from 7 pm on the day of entry into the accommodation.
2. Upon arrival at the accommodation, the Customer must immediately pay the price due for the room, number of nights of stay and additional services.
3. Upon full payment of the price, SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN will provide the Customer with the access key to the room, which will remain for the duration of the contracted stay.
4. On the date of departure, the Client must leave the room unoccupied with people and goods and without any damage by 12 noon.
5. If the room is not vacated by 12 noon on the day of departure, compensation corresponding to the price of a one-night stay in the accommodation will be immediately charged, with the right to use the room during this period only if rooms are available, otherwise you will have to to pay the compensation and leave the room as soon as possible.
4. Pets
1. It is expressly forbidden to house animals at SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN.
2. The introduction by the Customer of animals will allow SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN to immediately terminate the contract with the Customer and force him to leave without refunding the amounts paid in the meantime for making the room available during the contracted period of stay.
5. Terms of Use
1. Only persons named in the accommodation reservation will be entitled to use the accommodation room.
2. Customers must treat the accommodation room with care and consideration.
3. The Customer must treat the other customers of the accommodation with consideration and respect the rules of the accommodation posted therein, if applicable, which are also part of the accommodation contract.
4. The Client is not permitted to cook the food brought in, either in the accommodation room or in any other part of the accommodation premises.
5. Children are not allowed during your stay at the accommodation.
6. The Customer is strongly recommended not to keep or leave without any money, jewelry, valuables or other valuable items left in the accommodation room or in vehicles parked at SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN.
7. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN does not assume any responsibility in the event of theft, loss or deterioration of valuables such as money, jewelry or other objects of considerable value if such events take place in the accommodation room or inside parked vehicles in the car park.
6. Access to the room at SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN
SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN and its staff will have the right to enter the accommodation's room, during the Customer's stay, in order to carry out cleaning, repairs and similar work.
7. Price of stay and other prices
1. The price of the stay to be paid by the Client constitutes the consideration for making the use of the accommodation room available, in the period between arrival and departure.
2. The total price of the stay will be charged per night, regardless of whether the Customer actually used the room or spent the night there.
3. The applicable rates are the agreed prices or the price indicated in the price list in force on the date of conclusion of the contract. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN will have the right to increase or reduce prices if a period of more than 20 days elapses between the date of reservation by the Client and the date of arrival or if any taxes, contributions from visitors or other charges are changed or introduced.
4. The fees and amounts indicated in the terms and in the accommodation contract are all plus VAT, unless expressly provided otherwise.
8. Terms of payment
1. The amount of the stay and prices for additional services must be paid in advance, when the Client arrives at the accommodation, regardless of the billing date.
2. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN accepts payment by bank transfer (IBAN PT50 0033 0000 45419697780 05 BIC/SWIFT BCOMPTPL), PayPal Other payment methods will only be allowed in exceptional cases, with the timely consent given by SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN.
9. Complaints regarding material defects
1. The Customer must inspect the room upon arrival and immediately report any defects found at the reception of the accommodation.
2. Any defects that may arise during the stay must be reported to the reception of the accommodation as soon as the Customer becomes aware of them.
3. Upon verifying that there is indeed a defect in the Customer's room, SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN has the right to choose between repairing it and relocating the Customer to another available room.
4. For the aforementioned purposes, only serious defects likely to jeopardize the level of service and quality of SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN will be considered, and SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN is not obliged to take any measures in the case of complaints irrelevant, unreasonable or related to details that do not conflict with the minimum level of contracted service.
5. If SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN does not have the means to repair the relevant defect or replace the Customer's room, the Customer may only terminate the contract and receive the price paid for the room, and may demand nothing more from SEIXOMIL - BOUTIQUE DESIGN COUNTRY HOUSE whatever the title.
10. Liability by SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN
1. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN will only be liable for damages or losses to the Customer when such facts result from the faulty action of SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN.
2. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN does not assume any responsibility for loss of data provided by the Customer in the event of electronic transmission of payment data, being only responsible for this in the event of culpable action.
3. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN does not assume any responsibility for damages or accidents occurring inside the room or any part of the accommodation, unless such accidents are caused by faulty action by SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN.
4. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN will not be held liable to the Customer in the event of a delay in making the room available, provided there is a valid reason for not making the room available in time.
5. For the purposes of the previous number, valid reasons will be considered that make it impossible or more difficult to make the room available, such as, in particular, strikes, lockouts, natural disasters, accidents in the room itself or in the accommodation.
6. In the event of a delay in making the room available beyond 7 pm on the day of booking, the Customer may freely terminate the contract without having the right to demand any compensation from SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN of any kind.
7. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN does not assume any responsibility for acts performed by any employee of the accommodation, unless he is in his normal working hours, duly identified and in uniform as a company employee.
8. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN assumes no responsibility and cannot in any case be held responsible for non-compliance with ancillary obligations.
9. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN cannot, under any circumstances, be held responsible for the act or omission of any other Customer, even if this is likely to cause damage or harm to another Customer of the accommodation. Any and all damage caused to third parties by Customers of the accommodation will be the sole responsibility of these and completely foreign to SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN.
10. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN does not assume responsibility before the Client for any lost profits or indirect losses, even if resulting from failure to fulfill a main obligation.
11. Duty to notify
In the event of theft or damage to property or, in the event of fire, water damage or other damage to the accommodation's room, the Client must immediately inform the accommodation's staff and do everything possible to help resolve the theft or damage repair.
12. End of the accommodation contract
1. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN has the right to terminate the accommodation contract if the Customer fails to pay the price in full and on time when it is due or fails to provide the required guarantee.
2. Any contracting party may summarily terminate the accommodation contract for fair cause.
3. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN shall have the right to immediately terminate the accommodation contract for just cause if the Customer engages in any behavior that affects the good coexistence, peace or hygiene of the accommodation, namely if during their stay in the accommodation, the Customer is under the influence of drugs or alcohol, uses the accommodation room for prostitution practices, acts offensive to accommodation employees or other customers of SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN, disturbs the peace of other accommodation customers, or, in the past, has made malicious false bookings and/or has damaged or destroyed the accommodation or its facilities.
13. Data protection
1. The Customer is informed that their personal data will be stored and processed by SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN in accordance with the Law, for the purposes of contract execution, for the services provided to the Customer and for its own advertising campaigns .
2. The Customer grants SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN the right to use associated companies and selected service providers to carry out data processing and the right to transmit such personal data under this section to companies that allow them to store and process.
3. The Customer has the right to object at any time to the use of personal data for advertising purposes, and must therefore inform SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN in writing.
4. Unless otherwise provided by law, the Customer's personal data must be deleted when the accommodation contract ends and the legal retention periods have expired.
14. General provisions
1. The Terms and Conditions fully regulate the Customer's stay in the accommodation and the use of the room by the Customer.
2. No verbal agreement was reached throughout the accommodation contract, any and all changes to the contract between the parties must necessarily be included in a written document signed by both parties, unless it is a unilateral declaration, in which case it must be included in a written document signed by the issuer.
3. SEIXOMIL – CASA DE CAMPO BOUTIQUE DESIGN shall have the right to have third parties fulfill their obligations under and within the scope of the accommodation contract.
4. The nullity of one or more of the previous provisions does not affect the validity of the remaining provisions. The invalid provision will be replaced by the valid provision, the closest to the commercial and legal intentions of the parties or if this is not possible by the Portuguese legislation in force.
15. APPLICABLE LAW AND JURISDICTION
The Terms of Use, as well as the User's relationship with the company in accordance with them, are governed by the applicable laws of the Portuguese Republic. The User and the company agree to submit to the exclusive jurisdiction of the judicial courts of the district of Porto the resolution of any legal issues arising from the Terms of Use, without prejudice to the applicable mandatory legal rules. Notwithstanding the foregoing, the company may apply precautionary measures (or an equivalent type of urgent legal relief) in any jurisdiction.
